INTELLECTUAL PROPERTY PROTECTION

 First Light Safety Products, a division of Smartrend Manufacturing Group (SMG), Inc., owns several US and global pending patents that disclose and claim various inventive aspects of our Illuminated Traffic Paddle. 

On November 29, 2023 a jury in the U.S. District Court for the Western District of Michigan found that Opti-Luxx, Inc. (“Opti-Luxx”), willfully infringed upon two of First Light Safety U.S. Patents: Design Patent No. D932,930 and Utility Patent No. 11,348,491, by importing and selling in the United States Opti-Luxx’s Direct Mount, LED Destination School Bus Signs.

The conclusion of this 2-year-long case against Opti-Luxx came with the jury’s unanimous verdict in favour of First Light Safety. First Light Safety is confident the Court will now enter a permanent injunction enjoining Opti-Luxx, and those acting in concert with Opti-Luxx, from importing, making, using, and/or selling infringing bus signs. We are pleased to announce that the Federal Court in the Western District of Michigan has upheld the jury’s verdict finding that Opti-Luxx, Inc. (“Opti-Luxx”) willfully infringed two of our patents directed to our direct mount, selfcontained, LED illuminated bus signs. The Court then issued a “permanent Injunction” enjoining Opti-Luxx and those acting in concert with Opti-Luxx, from importing, making, using, and/or selling infringing bus signs or any other product not more than “colorably” different from the signs.
